Mediation is an Option for Employment Law Issues

An all-out hostile court battle is not the only method to solve issues that arise in the workplace. Mediation is an alternative dispute resolution form that allows parties to stay out of the courtroom and resolve issues in a less contentious manner. In mediation a neutral third party assists the parties with their dispute and works to come to a voluntary settlement of the dispute. The mediator offers suggestions and advises both parties about options and paths to agreement. The role of mediator is to be a facilitator who allows the parties to come to agreement. The parties are active in the dispute and the mediator works to keep them talking and coming to terms that both can agree will work.

Mediation can be used effectively for many types of business disputes, grievances, and employment issues. You may wonder why a disgruntled employee would choose mediation. A major benefit of this form of dispute resolution is that the mediation is completely private while court disputes are public. The hearings, award, and resolution are confidential. Skilled and impartial mediators can help negotiate sensitive matters. Mediation is also usually far less costly than a full blown court case. In addition, mediation may allow for a far quicker resolution of a dispute. Instead of taking many months in a courtroom, the parties may be able to come to terms in a short period of time.
