Arbitration and Mediation, Not Litigation

More and more businesses are turning to alternative dispute resolution (ADR) rather than going to court in order to resolve disputes. The goal of ADR is to come to an agreement without costly and time-consuming litigation. Also, ADR provides a more hands-on and controlled approach than you’d find in a courtroom.

Another benefit of arbitration and mediation is that it allows disputes to be resolved more quickly, as you don’t have to work your way through the court system and all its red tape. And, often you can agree to terms that a court wouldn’t be able to award, like structured settlements or job referrals.

  • Arbitration is a way of reaching a binding resolution while avoiding going through litigation. It’s less costly and many times more effective than going to court. A neutral third party hears both sides’ arguments and issues a written decision. Once agreement is reached, it’s generally binding.
  • Mediation uses a neutral mediator to help broker a settlement. Approximately 85% of disputes that go through mediation are solved. Once agreement is reached, it’s generally binding.
