Bringing a Wage Dispute Claim

In difficult economic times, many workers are grateful for employment. However, sometimes your job can turn into a nightmarish situation in which you find yourself subjected to illegal practices by your employer. You do not have to put up with improper treatment — such as not being paid the proper amount for the hours you worked.

The Fair Labor Standards Act requires that employers pay you for all hours worked and that you are paid the right amount for that work. The act covers a broad array of wage dispute issues that can arise in the workplace.

Some examples of wage disputes

Some instances when you may want to bring a wage dispute claim or lawsuit include the following:

  • Misclassification of your work as managerial so that you are not eligible for overtime. While certain jobs are exempt, if you spend a significant amount of time working in a non-exempt capacity you may be entitled to overtime pay.
  • Improper payment or calculation of commissions
  • Failure to be paid the minimum wage
  • Improper classification of your work to avoid benefits, overtime or payroll taxes
  • Being improperly refused breaks or meal time
  • Withholding your wages for illegal reasons such as breakage, cash register shortfall or spillage
  • Not allowing you to be paid for holidays, sick leave or personal days that are provided for in an employee handbook
