State and Federal employment laws do not require employers to pay severance upon the termination of employment.  However, when a company has a severance pay policy, the company must follow that policy.  Typically, employers only provide severance pay to employees who are laid off because of a job elimination resulting from a reorganization, restructuring, or downsizing, but some employers will give severance pay to employees terminated for poor performance, in recognition of their past service.  Severance packages may also be provided as part of a previously-negotiated individual employment contract.
